Final Order / Judgement

                    The case of the complainant is that he has deposited six lakh rupees and one lakh rupees vide deposit Nos.890,891 on 04/10/2014 with the opposite party.  They promised 18% interest for the deposit.  Both the deposits were due on 04/10/2015.  When the complainant demanded deposit amount with interest after the due date, the opposite parties were delaying the matter saying some more other reasons.  Hence a lawyer notice was issued on 26/11/2015.  But no relief received.  Hence this complaint is filed for getting that deposit amount with interest and compensation.

 

2.      On receiving complaint notice was properly issued to the opposite party whereas, even after appearing through a counsel the opposite party has not submitted any version before the Forum.  Hence the complaint was posted for evidence.

 

3.      From the side of complainant he has appeared before the Forum and filed proof affidavit in which he has affirmed and submitted all the averments stated in the complaint in detail.  He also produced 3 documents which are marked as Ext.P1 to P3.  Ext.P1 series (2nos) deposit receipts; Ext.P2-copy of lawyer notice dated 26/11/2015 with postal receipt and Ext.P3-A/D card.  Since there is no contra evidence available before us, we are inclined to accept the proof affidavit filed by the complainant.  We perused the documents produced as well as the contents of affidavit.   The Ext.P1 series two deposits receipts would go to show that the complainant had deposited on 04/10/2014 Rs.6,00,000/- and Rs.1,00,000/- with the opposite party at 18% interest rate.  Ext.P2 copy of lawyer notice would go to show that he has demanded those amounts on 26/11/2015.  If at all, there was any contra evidence for the opposite party, he ought to have been appeared before the Forum and submitted  their version.  Nothing has been done by the opposite party.

 

4.      In the result,  we allow this complaint and the opposite party is directed to pay Rs.7,00,000/- (Rupees Seven lakhs only) with 18% interest from 31/08/2015 to the complainant within  one month from  receiving  copy of this order.  Failing which, the complainant is entitled to get 18 % interest till realization.  There is no separate order regarding cost and compensation.
