The  concise fact of the case of the complainant is that the complainant Sanjit Mahato  purchased one  vehicle  from the OP NO.4 Prasenjit Roy  through OP NO.3 Bharat Mahato

bearing no. WB-89/0699. At the time of purchase OP No.3 proposed about the said sale of the car  for Rs.3,15,000/- with condition of EMI of OP NO.1&2 company  that is Manager  Mahindra and Mahindra  Finance Company  would be paid by the purchaser. But said finance company  was entitled  to get 20 EMI amount of the said  vehicle from OP No.4 Prasenjit Roy . The EMI amount  is  Rs.82,000/- per month . The complainant  agreed  verbally . On 22.12.2016 an agreement for sale of  that vehicle  was executed  and the complainant  paid Rs.3,15,000/- to the OP No.4 and purchased that vehicle.  The complainant  paid all the EMI in the account  of OP NO.3 and thereafter,  requested  to the OP No.4 to arrange the NOC as per the said agreement but he neglected  to perform his  part and asked to pay  more money.  Despite repeated  request  OP No.1,2 &3 did not take any steps for giving  the NOC. The Opposite parties  have thereby  violated  the RBI guidelines and caused breach of trust.  So, the present  case is filed.  The cause of action arose on 2212.2016 and thereafter,  everyday  till the filing  of this case.  The complainant prayed  for  an award directing the  OP No.1&2 to issue NOC in favour of the  complainant. Rs. 1,00,000/- towards mental pain and agony, unfair trade practice  and litigation cost.

As per in order no. 8 dated 23.12.2019 and order no.15 dated 25.02.2022 the case was decided  to be heard ex-parte.

The complainant  order to  substantiate  the case adduced  oral evidence  in the form  of affidavit in chief  and documentary  evidence by filing  the documents as annexed 1 to 5.

Annexure-1 is the Registration  Certificate of the vehicle bearing registration no.WB-89/0699.

Annexure-2 is the  sale agreement between Sanjit Mahato and Prasenjit Roy.

Annexure-3 is the  road permit.

Annexure-4 is the Tax Receipt.

Annexure-5 is the bank statement of Bharat Mahato

All the   documents  proved  by the complainant stand  unchallenged and undiscarded. The specific  evidence led  by the complainant  in his evidence  on affidavit clearly established  that the allegations against the opposite party by the complainant  stand well established  and duly proved .

Thus  having  assessed the entire oral and documentary  evidence  of the complainant  which could not  discarded  by the

opposite party and having considered  the unchallenged  testimony  of the complainant it is reasonably  held that  the complainant successfully proved  the case against the  opposite parties.

The misdeeds  done by the opposite parties in not complying  the terms of the agreement,  it tantamount  to unfair  trade practice  which  caused mental pain and agony to the complainant  and it should be  compensated  in terms  of money.

In the result  the complaint case succeeds ex-parte against the  opposite parties  with cost.

Hence,

that the complaint case no.CC/68/2019 be and the same is allowed ex-parte against all the OPs with cost of Rs.10,000/- (Rupees ten thousand). The complainant Sanjit Mahato  do get an award  with a direction  to OP No.1&2 namely Bharat Mahato and Prasenjit Roy  respectively  with a direction to  issue NOC of  the said  vehicle  bearing no.WB-89/0699 in favour of the complainant within  30 days from the date of the final order , Rs.50,000/- (Rupees fifty thousand) towards mental pain  and agony and unfair trade practice  and Rs.10,000/- (Rupees ten thousand) towards litigation cost. The OP No.1&2 are directed to pay  Rs.60,000/- (Rupees sixty thousand) to the complainant within 30 days  from the date of final order failing which the entire  award money shall carry an interest  @8% p.a  from the date of final order  till the date of its realisation.

All Interim Applications  (I.A) stand disposed of  accordingly.

The case is accordingly disposed of.

Let a copy of this final order be supplied to both the parties at free of costs.”
