ORDER NO. 07     Date :    24. 09.2019

                Both parties are present through their respective Lawyers.

                Complainants file an application praying for dismissal of the instant Consumer Case on the ground that the OP has already settled the dispute outside the Forum by making payment of Rs.4,50,000/- through a cheque bearing No.013918 dated 09.09.2019 drawn on HDFC Bank. Copy served and no objection is endorsed.

                We have heard both sides and also perused the impugned application. On scrutiny of the impugned application, we find that the parties to the complaint have already settled their dispute amicably outside the Forum and in terms of such settlement the OP issued a cheque of Rs.4,50,000/-  in favour of complainant-1. The parties amicably settled the dispute and the complainants intend to dismiss the complaint. Therefore, there is no legal bar to entertain the application.

                Hence,

ORDERED

                That the complaint case be and  the same is dismissed for non prosecution as prayed for without any costs.

                Thus, MA No. 522 of 2019 is disposed of.
