Hazira is filed on behalf of the Complainant through Advocate.

Step is taken on behalf of the O.P., through Advocate praying for submission of written version.

The case is fixed for filing W.V. I/D ex-parte hearing.

The O.P. has got sufficient opportunity to file w.v. and hence further opportunity cannot be granted for filing w.v. after long expiry of the statutory period.

Hence the case is taken up for Ex-parte hearing.

The Complainant is a bona fide consumer under O.P. having Meter No. being 1769786. Unfortunately the Complainant’s service connection was dis-connected on 19-07-2013 by the O.P. for reason best known to the Authority. Thereafter Complaint was lodged before the Departmental Grievance Cell namely D.E. & R.G.R.O., Bankura who disposed of the complaint by order dated: 20-08-2013 directing the O.P. for reconnection of the service line on payment of Rs.25,982.45 as outstanding dues according to the claim of the Complainant but the O.P. without adhering to the above mentioned order made the Complainant to deposit Rs.29,072/- for the Bill period of January, 2012 to March, 2013 under receipt No.130600213510.

The Complainant has therefore approached this Commission for refund of the excess payment with interest and compensation.

Having gone through the order of the R.G.R.O., Bankura and other materials on record the Commission finds that the O.P. authority has not acted according to the direction of the R.G.R.O. by demanding excess payment of Rs.3,089.55    (Rs.29,072.00 – 25,982.45) which the O.P. is liable to pay to the Complainant.

The case succeeds Ex-parte.

                  Hence it is ordered……..

That the case is allowed Ex-parte against the O.P. directing the O.P. to pay to the Complainant Rs.3,089.55 or preferably adjust the said amount with the Qurterly bill period ending March, 2023.

Both parties be supplied copy of this judgement free of cost.
