The Ld. Agents of both sides are present.

Today is fixed for further hearing of argument.

At this stage, the Ld. Agent for the Complainant files a verified petition duly signed by the Complainant praying for withdrawal of the complaint with a liberty to file afresh on the same cause of action.

Perused the petition.

The Ld. Agent for the Complainant submits that Smt. Anjali Das, mother of the Complainant is the consumer of the O.Ps but the case has been filed without any letter of authorization.

It is urged that Smt. Anjali Das is still alive. He prays for allowing the complaint to withdraw the case with a permission to file the case afresh on the same cause of action.

The Ld. Agent for the O.P. No.1 raises objection. He submits that the Complainant may be permitted to withdraw the case without liberty to file afresh on the same cause of action.

Heard both sides.

Considered.

We find that the Complainant has prayed for withdrawal of the same for some technical defect.

We think that neither of the parties will be prejudiced, if the prayer of the Complainant is allowed.

Hence,

                The Complainant be permitted to withdraw the case with a liberty to file afresh on the same cause of action, if not bared by law.
