ORDER

Decree-holder filed an Execution Suit on 1.10.2018 alleging non-compliance of the order of this Forum dt. 27.6.2018.

 

On argument hearing date the Ld. Lawyer for the decree-holder submitted before this Forum that the STW connection has been effected on 26.11.2017; it means Judgment-debtor has violated the order of this Forum dt. 27.6.2018 where it was stated that the OP is directed to get the shallow machine of the complainant connected properly within 3 weeks from the date of this order, failing which a compensation of Rs.70,000/- and the cost of litigation for an amount of Rs.10,000/- are to be paid to the complainant within 45 days from the date of this order.

 

The Ld. Lawyer appearing for the Judgment-debtor with documents submitted as fristi has proved that the order of this Forum dt. 27.6.2018 had been properly observed as STW connection had been effected on 11.7.2018 and it was intimated to the concerned decree-holder and this Hon’ble Forum on 12.7.2018 vide Memo No. PCCC/LI/240 dt. 12.7.2018 and Judgment-debtor Memo No. PCCC/LI without date respectively. Moreover, the Ld. Lawyer appearing for the Judgment-debtor has submitted a report of full satisfaction of the decree-holder  signed on 26.11.2018.

 

No deficiency in service has been proved on behalf of the Judgment-debtor in the instant case. So, the case is disposed of on contest without imposing any cost.

 

 

 

            Let a copy of this order be supplied forthwith to the parties concerned free of cost.
