ORAL ORDER

Per – Hon’ble Mr. Justice S. B. Mhase, President

          Heard Adv. Vijay Kanthe on behalf of the Applicants/Appellants and Adv. S. Hussain on behalf of the Non-Applicants/Respondents on the application for condonation of delay.

[2]     This is an application for condonation of delay of 37 days in filing the appeal.  The case made out by the Applicants/Appellants is that the Applicant/Appellant No.1, Mr. Krishna Sidapa Kamble was suffering from acute bronchitis coupled with fever and weakness and he was under the treatment of the doctor.  Medical Certificate issued by a doctor to that effect is produced on the record.  Learned Advocate for the Non-Applicants/Respondents has not challenged the documents produced on the record, especially the medical certificate.  He states that looking to the papers, the Commission may take an appropriate decision.  Since, there is no serious opposition on the part of the Non-Applicants/Respondents and in view of the fact that the Applicant/Appellant No.1 was suffering from illness (as stated in the medical certificate) we condone the delay.  No order as to costs.  Order accordingly.
