Today is fixed for further hearing and order.

It appears from the case record that complainants are not taking steps in this case since 08.05.2019. Today complainants are also without any step. O.P. Nos.1 & 2 files a petition stating the fact that Title Suit No.122/2019 is filed by the complainants in the appropriate Civil Court regarding the dispute in question between the parties as in view of the order of this Forum dated 10.04.2019. This Forum holds that since it is purely a case of rival claim for the insurance policy between the complainants and others of the deceased life assured Lt. Surajit Panja. This Forum has no scope and validity to decide this dispute in this Forum and as the parties preferred to file a Civil Suit as we have stated above. Therefore, complainants have lost interest to contest this case further in this Forum and  are taking no steps.

Hence, it is

O r d e r e d

that the Consumer Complaint being No.53/2018 be and the same is dismissed for non prosecution without any cost.

Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
