The case of the complainant is that,
Complainant availed a loan of Rs.1,18,000/- from the opposite party bank and failed to remit the instalment properly due to the crop failure. On 05/12/17, the complainant received a notice from opposite party bank demanding Rs.1,79,798/- as loan dues including interest. Thereafter the complainant approached opposite party with an amount of Rs.1.5 Lakh, opposite party denied to accept and demanded more amount. Complainant further contented that the opposite party charged exorbitant interest and denied the request of the complainant for one time settlement facility caused much mental pain and hardships to the complainant and the act of the opposite party amounts to deficiency in service.
Hence the complainant filed this petition for directing the opposite party to settle the loan account with 12% interest and to settle the loan under one time settlement scheme, and also direct the opposite party to pay cost and compensation.

Upon notice opposite party entered appearance and filed version stating that the matter is already decided by the Co-Operative Arbitration Court, Nedumkandam on 28th March 2018, and they are prepared to execute the award.
On perusing the award copy, the Forum convinced that the Award passed by the Co-Operative Arbitration much earlier of filing this petition. The petition is filed before this Forum was on 18/05/18. Hence as per the decision of Hon'ble National CDRC in Jagadish Kainthik Vs Bajaj Alliance Company (2016) CPJ Vol.IV P.12, the complaint will not maintainable. Hence on such ground complaint is dismissed.
