The State Commission has modified the order passed by the District Forum without issuing notice to the petitioner who was the respondent before the State Commission.  It is a cardinal principle of law that nobody can be condemned unheard.  Since the impugned

order has been passed in violation of principles of natural justice, the same is set aside and the case is remanded back to the State Commission to decide it afresh after hearing both the parties.

          Parties through their counsel are directed to appear before the State Commission on 04.1.2011.

          Since it is an old case, we would request the State Commission to decide the appeal within four months of the first date of appearance, if possible.
