Opposite party 1 is not present.  On the side of the complainant it is represented that the Opposite party 1 is not taking steps to execute the cancelation deed of the mortgage deed.

 

 

                        The complaint is closed with the direction that the Opposite party 1 shall execute the cancelation of the mortgage deed on or before 15.12.2014 failing which the opposite party 1 shall be liable to pay the sum of Rs.5,000/-(Rupees five thousand only) to the complainant with interest at the rate of 12% per annum from the date of this order till date of its realisation.
