| Final Order / Judgement | The case is posted today for filing of postal tracking report against O.P No.5 by complainant & hearing on interim petition on contest. Advocate for the complainant is absent, no steps filed. Advocate for the O.Ps No.1 to 4 is present & files hazira. On repeated calls, none respond on behalf of the complainant. Hence, hearing of the case could not be taken up. Perused the case record. In the present case, the O.Ps No.1 to 4 were appeared & filed w/v. As the complainant has not filed postal tracking report/ fresh step against O.P No.5 till today, hence the case against O.P No.5 is dismissed. The interim petition Dtd. 27.03.23 filed by complainant is disposed of, as none moved the same. As it appears from the case record that the complainant remained absent since 07.07.23 to till today, for which hearing of the case impaired and the valuable time of this Commission is being wasted. Considering the nature & conduct of the complainant, this Commission is of the view that the complaint of the complainant should be dismissed. Accordingly, the complaint of the complainant is dismissed for non-prosecution of the case. The interim order, if any, passed against the O.Ps is treated to be infructuous. | |
