The complainant filed this case with allegation that the complainant purchased a mobile set from o.p. no.1 and instead of providing him with 3G mobile set the complainant was provided with 2G mobile set, for which the complainant filed this case against the o.p. praying for refund of the price of the mobile set as well as compensation.

On perusal of the record we find that the complainant filed a cash memo whereby it was stated that he purchased 3G mobile set. Apart from the said fact the price of the mobile set was Rs.3000/- only and the same was purchased in the year 2015 after the lapse of so many months the complainant woke up from the sleep and has come before this Forum claiming the refund of the price of the mobile set along with compensation.

In order to substantiate the claim of the complainant no document has been filed in support of his contention that o.p. committed any fraud on him. In view of the said fact we do not find any merit to issue notice against the o.p., therefore the case is dismissed in limini.
