Final Order / Judgement

Order-4.

Date-27/11/2019.

Today is fixed for passing order.

On scrutiny of the complaint petition, it appears that the Op-4 have sent Show cause notices to the Ops-1 and 2 by speed post with A/D through the Op-3, Alipore Head Post Office on 13/01/2017 and due to non-return of A/D from the concerned P.O, the Appeal of the petitioner filed before the Op-4 could not be proceeded  and accordingly the petitioner suffers a lot and there is laches of service of the postal authority.

According to the petitioner, the question arosed to him on the point what circumstances the Op-4 allow the deficiency of service.

Prayer of the petitioner is for praying necessary order directing upon the Ops-1 to 3 to pay the sum of Rs.30,000/- and Rs.10,000/- as litigation cost to the Dhr for harassment and mental agony respectively.

Considering the whole, it is our considered view that the Op-4 hires service from the Op-3 on 13/01/2017 and as such there is transaction in between the Op-4 and the Op-3 and the present petitioner  hires no service from the ops and hence, the present petitioner cannot be  a consumer as per provision laid down in the Cp Act 1986.

In the light of discussion above, the complaint petition being no.431/2019 is not admitted.

Accordingly the Misc Application U/S-11 2 (b) of the C.P Act being no.MA/575/2019 stands dismissed.
