Both the parties file hazirah.

The petition of the Complainant dated 12.07.23 is taken up for hearing. The contention of the Complainant is that there is a technical error in the present case and subsequently it was fixed for taking steps by the Complainant. The Complainant presently wants to withdraw the case with a liberty to file afresh before the proper Forum.

There is an endorsement in the petition that due to non-availability of the Ld. Defence Counsel copy could not be served. Copy attached.

Perused the petition. Heard, the submission. Considered. It appears that the Complainant wants to file the case before the appropriate Forum/ Commission. Since the Complainant voluntarily wants to withdraw the case and it is duly authenticated by the Ld. Counsel for the Complainant, so having considered the voluntariness of the Complainant, she is permitted to withdraw the case.

Hence, it is

Ordered

That the Complainant is permitted to withdraw and the complaint case No. CC/112/2017 is accordingly disposed of.

Let a copy of this order be sent to the parties free of cost.
