This is a complaint made by one Ranjit Nath of 16/D, Panditia Road, Kolkata – 700 029, against Post Master, 211, Sarat Bose Post Office, P.S. Tollygunge, praying for a Government Job and refund of Rs. 3,00,000/- and compensation of Rs. 50,000/-.
Facts in brief, are that the Complainant had applied for the post of Lower Division Clerk in the Judgeship of Hooghly vide Notification No. 1/12015 dated 25-05-2015. The office of the District Judge sent admit card to the Complainant via Post Office which was received on 17-12-2015 and the Complainant found the date of examination was on 29-11-2015. So, the Complainant filed this case.
OP filed written version and denied all the allegations of the Complainant. Further, OP has stated that in terms of Section 6 of the Post Office Act, the OP has no liability. It is also alleged that the envelope was sent to Deshapriyo Park P.O. as it appeared from the outer wrapper and so, delay was caused. Accordingly, OP has prayed for dismissal of this case.
Decision with reasons
On the basis of facts stated in the petition of complaint, the case was admitted and OP filed written version. Against this, Complainant filed affidavit-in-chief to which OP filed Questionnaire and in turn, the Complainant filed affidavit-in-reply.
Thereafter, the OP filed Evidence-on-affidavit against which the Complainant filed Questionnaire to which OP filed affidavit-in-reply.
Main point for determination is whether the Complainant is entitled for relief which he has prayed for.
First relief the Complainant sought for is that he wants a Government job. This is beyond the jurisdiction of this Forum and there is no material why such a prayer has been made.
Second prayer is refund of Rs. 3,00,000/-. There is no material as to when, where and to whom the Complainant gave Rs. 3,00,000/- and how he is seeking Rs. 3,00,000/- from the OP. He has not alleged that he gave this money to the OP.
Final prayer is compensation of Rs. 50,000/-. Complainant has prayed this relief because he could not appear in the examination. The address of the Complainant, as it appears from the petition of complaint, is 16/D, Panditia Road, Kolkata – 700 029 which he mentioned in the envelope. It further transpires from the envelope that the Complainant additionally mentioned Deshapriyo Park under P.S. Gariahat on the envelope. There is every reason to believe that mentioning of this additional information on the envelope led to the confusion and resultant delay in delivering the mail to the addressee after routing through Deshapriyo Park Post Office.
Further, the affidavit-in-chief, Questionnaire and affidavit-in-reply of both the sides reveal that they have asserted their respective allegations, but the reliefs which the Complainant has prayed for, do not appear to be in accordance with law. This Forum does not have jurisdiction to allow these reliefs.
Accordingly, there does not appear any material to allow these reliefs.

that CC/21/2016 be and the same is dismissed on contest.
