No one appears on behalf of the complainants even on the second call. On perusal of record, we find that no one had appeared on behalf of the complainants on the previous two hearings. On hearing dated 21.05.2013 court notices were directed to be issued to the parties as well as their counselsreturnable on 16.09.2013. Notices of the complainants were not received back. However, notice of the counsel was received with the report eft Therefore, on hearing dated 16.09.2013, fresh notices were directed to be issued to the complainantsreturnable for today. As per report of the Registry, court notices to the complainants were issued on 01.10.2013 at the correct addresses which have not been received back. There is a presumption of service of notice on the complainants. Since no one has turned up on behalf of the complainants even on the second call, the complaint is dismissed for non-prosecution.
