The New India Assurance Co. Ltd., office at Gagan building G.T. road Karnal, through its Divisional Manager/Branch at Karnal.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Dheeraj Sachdeva, counsel for the complainant.

                   Sh. Gurmit Singh Juneja, counsel for the OP.

                                     

                   File taken up today, on the application moved by the learned counsel for the parties to withdraw the present complaint.

        At this stage, learned counsel for the OP has suffered his separate statement to effect that the matter has been compromised between the parties and as per compromise OP is ready to pay Rs.65,000/-. Full and final settlement will be done within 30 days from the date of receipt of the order.

                 On the other hand, learned counsel for the complainant has suffered his separate statement to the effect that the matter has been compromised with the OP, so he does not want to pursue with the present complaint further and withdraws the same being compromised. If the payment is not made within 30 days of the order passed by this Hon’ble Commission, the OP may kindly be directed to pay interest @ of 12%.

       In view of the above statements, the present complaint is hereby dismissed as withdrawn being compromised. Both the parties will be bound by their statement. It is made clear if the OP failed to made the payment within stipulated period, interest @ 12% will be carried from falling the present complaint. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
