This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. The notice issued to the 2nd opposite party was accepted. As the 2nd opposite party not entered appearance on the date fixed for that purpose or on subsequent dates and hence 2nd opposite party was called absent and set ex parte on 12/10/2018. Since 01/08/2019 this case was adjourned for the purpose of taking steps against the 1st and 3rd opposite parties. When the case came up for consideration today, it is noticed that the complainant is continuously absent and not taken any steps against the 1st and 3rd opposite parties. A notice was also issued by this Commission to the complainant for her appearance before this Commission to further proceed with this complaint. Inspite of giving sufficient opportunities the complainant failed to take any steps against the 1st and 3rd opposite parties. In view of the continuous absence of the complainant and the fact that the complainant has not taken any steps against the opposite parties 1 and 3, we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
