Sri Binoy Kamila files this case with some Xerox copies of documents against Wynncom Telecom Ltd. & also with DD no.935878 dtd.01.02.2013 amounting Rs.100/- as per C.P. Act since claim valued for Rs.10,700/-.

          Heard the Ld. Advocate for complainant/Petitioner. It should be mentioned that cause of action arose on 28.12.2010 at contai and on 07.06.2012 when refusal by the OP to repair the mobile phone in question as stated in paragraph 14 of petition of complaint. but in para 9 of the same, it has been stated that the said mobile set was returned with a demand to pay Rs.400/- for repairing charges. This statement does not disclose any date and it is not clear from any materials and papers on record as to whether the complainant paid such repairing cost or the OPs refused to accept the said mobile set for repairing.

          For the above referred reasons we find that the complainant has failed to make out prima facie case to admit this complaint.

          That being so, we hold accordingly that the instant complaint Case is not admitted and stands rejected.
