Complainant Chandan Saha is present along with his Advocate.
Ld. Advocates for the opposite party nos. 1, 2 and 3 are also present.
The case is taken up for disposal before the National Lok Adalat.
Heard the Ld. Advocate for the complainant who submits that his client claim of Rs. 9,50,000/- (Rupees nine lakhs fifty thousand) excluding compensation, interest and litigation cost. He further submits that the opposite party nos. 1 to 3 are ready and willing to pay a sum of Rs. 7,29,721/- (Rupees seven lakhs twenty nine thousand seven hundred twenty one) in terms of the Mediclaim Policy.
On the contrary, the Ld. Advocates appearing for the opposite party nos. 1 to 3 submit that the complainant is entitled to get Rs. 7,29,721/- in terms of the insurance policy and if the complainant produce any document relating to the balance claim in that event they will disburse the balance amount in due course as per policy terms and conditions.
Having heard the both sides and on perusal of the complaint petition as well as its written version thereof, we direct the opposite parties 1 to 3 to pay a sum of Rs. 7,29,721/- (Rupees seven lakhs twenty nine thousand seven hundred twenty one) to the complainant through NEFT (National Electronic Funds Transfer).
The opposite parties 1 to 3 are further directed to release the balance amount of Rs. 2,20,279/-, if admissible to the complainant on production of original documents relating to his claim and/or its photocopies duly signed by the complainant in terms of the Mediclaim Policy.
Thus, the complaint case is disposed of in the above terms and conditions. The complainant is directed to produce original documents and/or its photocopies to the opposite party nos. 1 to 3 within 30 days and the opposite party nos. 1 to 3 are also directed to verify those documents and release the balance amount as per terms and conditions of the Mediclaim policy. He is also directed to produce bank details and PAN Card to the opposite party nos. 1 to 3 for disbursement of Rs. 7,29,721/- within 15 days and the opposite party nos. 1 to 3 are directed to release such amount to the bank account of the complainant through NEFT within 7 days of receiving bank details and PAN Card.
