          This is a complaint filed u/s 12  of Consumer Protection Act, 1986 for directing the Opposite Parties to replace the new split ONIDA Air Conditioner Machine with new one similar description which should be free from defect;  or to return the purchased price of Air Conditioner Machine and Stabilizer for a sum of Rs.29,500/- and Rs.4,000/- to the total for a sum of Rs.33,500/- paid by the complainant to OP1;  to pay a sum of Rs.10,000/- for mental agony;  to pay a sum of Rs.5,000/- towards transportable charges and Rs.5,000/- towards cost of this litigation.      

          2. Notice to the opposite parties were duly served.  The first opposite party appeared through Counsel and filed reply version, the second opposite party appeared in person, the third opposite party remained absent and set ex parte.  The complainant was examined as CW1 and Exs.C1 to C6 were marked.  One Thiru Perinba Selvam, Manager of OP1 examined as RW1, no documents were marked.  Hence, the matter was posted for evidence of OP2.

          3. Today this complaint was called.  Complainant absent.  Counsel present.  OP1 present.  OP2 absent.  OPs Counsel absent.  Counsel for complainant filed memo of full satisfaction and prayed for disposal.  In view of the memo filed by the Counsel for complainant, this complaint is hereby dismissed as not pressed.  The memo shall form part and parcel of this order.

EXTRACT OF MEMO FILED BY THE COUNSEL FOR COMPLAINANT

 

          That in the above said case, the opposite parties No.1 and 2 have replaced the new ONIDA Air Conditioner and also they have paid a sum of Rs.5,000/- (Rupees five thousand only) towards the compensation to the complainant directly.  It is further submitted that the said case is settled as full satisfaction. 

Hence, it is prayed before this Hon'ble Counrt may peruse this memo and record and to dispose the case as this Hon'ble Court deems fit and proper in the interest of justice.
