Final Order / Judgement

O R D E R

            The  complainant’s case is as follows:  On 4/4/07 the complainant had given  his canon printer to the respondent firm for repair.  The said printer was purchased on 10/3/06 from the  ‘Sharp logic’ for Rs.2,600/- as per invoice No.10008.  He several times demanded the respondent to return his printer  after repair.  But the respondent delayed by saying one or other reasons.  Finally in 9/2007 the respondent informed that they had lost the said printer.  As the respondent was not willing to give compensation, he sent a registered notice to the respondent on 28/9/07.  But no reply and no remedy so far.  The non-return of the repaired item shows deficiency in service and unfair trade practice.  Due to the said act of the respondent he had to approach other firms to take prints and there by suffered financial loss and time loss.  Therefore the respondent is liable to compensate for their deficient activity.  Hence the complaint.

 

          2. The respondent is called absent and set exparte.

          3. To prove the case of the complainant  he filed affidavit and produced Exhibits P1 to P4 documents.

          4. According to the complainant he had given his printer  for repair in the respondent firm on 4/4/07.  But the respondent has not returned the said printer after repair.  He several times demanded to return the said printer but the respondent delayed by saying one or other reasons. Finally in 9/07 the respondent informed that the said item was lost.  He demanded compensation for the said item through a registered notice on 28/9/07.  But no remedy so far.

          5. There is no evidence to the contrary.

 

          6. In the result the complaint is allowed and the respondent is directed to pay Rs.2,200/- (Rupees Two thousand and two hundred only) towards the cost of the printer and also to pay Rs.2,000/-(Rupees Two thousand only) as compensation and Rs.500/- (Rupees Five hundred only) as costs within one month from the date of receipt of copy of  order.
