Final Order / Judgement

Today the instant case is fixed for admission hearing.

The complaint is absent without any step.

 It is now 1:50 PM.

It is seen from the case record that the instant case was filed on 16.10.2020.  Since thereafter, several dates have been elapsed but the complainant did not appear after filing the case.

Due to Covid- 19 pandemic situation, the case is adjourned for more than 3 to 4 times and ultimately on 01.02.2021 last chance was given by this Dist. Commission and fixed 15.02.2021 but, even such opportunity was given to the complainant the complainant did not appear on 15.02.2021 and thereafter this District Commission gave one more chance, as special chance and fixed today for admission hearing but the complainant remained absent today. Despite giving several opportunities the complainant did not appear since after filing the case. We think that most probably the complainant lost interest in the case and not like to proceed further.

 As per law, the admissibility of the case should be heard within 21 days from the date of filing. Due to Covid-19 situation the Dist. Commission took lenient view but even then the complainant is absent and therefore we left no option but to dismiss the case.

 

Hence,

It is ordered,

 

That the consumer complainant being CC/145/2020 is dismissed for default.

Let a free copy is given to the parties concerned as per provision of the CPR 2020.

FINAL ORDER

 

 The complainant filed the consumer complaint as noted above. Despite several opportunities given the complainant did not turn up and therefore, the case is dismissed for default.  The order is written in separate sheets vide order No: 7 dated 22.2.2021 which do form the part of this order.

 

Hence,

 It is ordered that the C.C No: 145 of 2020 is dismissed for default.
