This complaint coming for final hearing on 26-10-2017 in the presence of Complainant appeared as in person and Opposite party called absent and set–exparte on 24-7-2017, and upon perusing the material papers on record, the Forum made the following:-

 

                                                                                                       O R D E R

 

 (Per Smt. K. Sireesha, Member),

  1.          The complainant filed this complaint under section 12 of Consumer Protection Act, 1986 (for short herein after called as C.P. Act). The complainant has purchased Hero Maestro Two Wheeler Vehicle from Sri Gopal Auto Service Show Room , under loan from HDFC Bank the respondent given quotation for Rs.64,000/-. The complainant paid Rs.19,100/- as down payment on 15-6-2016 but in the original bill the price is mentioned as Rs.56,000/- the original bill sent to the RTO office. there is variation of Rs.8,000/- but the bank has replied that is not concerned to them. The complainant went to the Gopal Auto Show Room i.e., Respondent and asked about the variation but they did not respond. The complainant serving notice to the respondent on 29-4-2017 but there is no reply from respondents. Hence this complaint.

 

           Therefore the complainant prayed Hon’ble Forum pass an order against the respondent to pay Rs.8,000/- the difference amount, and pay Rs.20,000/- for mental agony and pay Rs.2000/- for expenses.

 

 

 

           Opposite party is remained ex-parte on 24-7-2017.

The complainant filed documents and marked as Ex.A1 to Ex.A9.

 

           From the above averments these points were taken for consideration;

           Point no.1:- Whether the complainant is entitled for compensation as prayed by him or not ?

 

           Points No.2:- Whether there is deficiency of service or negligence on the part of the respondent or not ?

           Point no.3:- To what relief ?

 

           Point no.1 and 2:- It is true from the complaint and Ex.A5 filed by the complaint, the complainant had purchased the Hero Maestro Two Wheeler on 15-9-2016 from the respondent. It is very clear under Ex. A9 that the price of the Two Wheeler with all showroom price plus life tax plus insurance plus helmet plus extra warranty total comes to Rs.66,045/-  The respondent did not filed a piece of evidence which supports his case. He did not show the variation of Rs.8000/- under any document filed by him. There is no clarity in the complaint filed by the complainant. In these circumstances the complainant is not eligible for any compensation as prayed by him at the same time, there is no deficiency of service on the part of the respondent.

 Point No.3:- In the result, the complaint is dismissed without costs.
