          This is a complaint filed under section 12 of Consumer Protection Act, 1986 for  directing the opposite parties jointly and severally to pay to the complainant the loss amount of rs.42,400/-, the value of mobile phone or replace the mobile phone with similar description free from defect  with subsequent period of one year warranty; to pay a sum of Rs.45,000/- for mental agony, to pay a sum of Rs.10,000/- for cost of this complaint.
