No step is taken on behalf of the complainant who is found absent on repeated call. Step is taken on behalf of the O.P.through advocate Somnath Roychowdhury.

The case is fixed for argument.

It appears from the record that the instant case was filed on 19-08-2015 and the complainant made his appearance last on 27-11-2017. Thereafter the case was fixed for argument as the O.P. filed W.V. to contest the case. A series of adjournment has been granted for argument even after cessation of Covid 19 Pandemic and Ceasework of the local Bar Association.

The complainant is perhaps not interested to continue the case. In absence of the complainant the case cannot be decided on merit.

Hence it is ordered………

That the case is dismissed for non-prosecution.

Both parties be supplied copy of this judgement free of cost.
