Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  None for the complainant.

Shri Dheeraj Sachdeva, counsel for OPs.

                 

                                Today the case is fixed for consideration on the application for dismissal of complaint. None has appeared on behalf of complainant.

                   Case called several times since morning but none has put into appearance on behalf of the complainant. Position remained the same on the adjourned date.It is already 03:30 PM. It appears that complainant is no more interested to pursue his case. In view of the above, further adjournment for the same purpose would not be justified at it would amount to wastage of precious time of this Commission and harassment of the OPs. Moreover, in the present complaint arbitration award has been passed on 17.08.2023 before filing the present complaint.

                   Hence, in view of the above facts, the present complaint is dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
