Advocate for complainant filed a memo to withdraw the complaint and permit them to file before the District Commission as it has pecuniary jurisdiction as per Consumer Protection Act, 2019.

Pecuniary jurisdiction has to be calculated on the amount paid towards purchase of the product.  Here we noticed that policy was purchased by husband of complainant by paying annual premium amount of Rs.9,300/-.  District Commission has pecuniary jurisdiction to entertain the complaint irrespective of claim made by complainant.  Accordingly, in view of the provision Section 34(1) of Consumer Protection Act, 2019, the complaint is returned and directed to file before the District Commission. 

The court fee which has been paid is sufficient to entertain the complaint.
