Benijeer Beekh        Vs.    The Manager CPP Group of India.

 

Present:       None for the complainant.

                    Opponent No.1 ex-parte.

                    Sh. Naveen Kumar Kaushal, Adv. for the opponent No.2.

 

                    The compliance of order dated 03.08.2023 has not been done by the complainant. However, despite case called several times, complainant failed to appear before the Commission either in person or through any advocate, upto 3:30 PM, whereas the counsel for the opponent No.2 repeated came into the Commission.

                The pivot of the case is revolving around the policy bearing No.OG-20-9999-9960-00000079, but the complainant herself failed to produce the policy documents on record and this duty is to be discharged by herself and despite availing five effective opportunities including last one and more than reasonable time, the complainant failed to produce the policy documents before the Commission and non production of the policy documents by the complainant is a patent defect in the complaint and due to this reason, complaint is not maintainable. The present complaint is dismissed, being non compliance of order dated 03.08.2023, vide which she was asked to produce the policy documents. However, complainant shall be at liberty to file afresh complaint against the opponent, if she come into possession of the policy documents pleaded by herself in para No.2 of the complaint. File be consigned to the records.
