The Complainants and OPs called out absent.

 

This Forum by its order dtd.19.10.16 dismissed the complaint for not taking steps and for non-prosecution. As against the said order, the Complainants filed Miscellaneous Petition No.05/2016 which was came to be allowed on 21.12.18 and restored the present complaint to its original proceedings and directed the Office to issue Forum notice to both the parties to appear before this Forum on 04.02.19. In this context, notice has been issued to both the parties. Notice send to the Complainant returned with an endorsement ‘addressee left’, notice send to OP.1 also returned with an endorsement ‘left’. Notice send to OP.2 duly served. OP.2 called out absent and placed exparte.

 

The Forum notice send to the Complainant’s address as shown in the complaint. As the Complainants left from the given address, notice returned unserved with shara ‘addressee left’. When the Complainants are not available in the given address, there is no useful purpose for re-issuance of notice by this Forum to prosecute their case. Hence, this Forum has no other go except to dismiss the complaint. Accordingly the complaint is dismissed for the reasons stated above.
