Today is fixed for admission hearing.
Complainant files hajira through Ld. Advocate.
Heard the Ld. Advocate for the complaint in full.
Perused the complaint and xerox copies of the documents so filed by the complainant.
Complainant alleged in the petition of complaint that on 26.06.2021 he had purchased one spectacles from OP no. 1 on payment of Rs. 11,989/- but after 10 months said fram starts rusting and corrosion and also tinted and become unuseable and glass of the spectacle also not able to met the assure presification as expect by the complainant.
He further alleged that vision of the glass become hazi and cannot give any clarity to look and read and in total whole spectacles becomes unuseable.
But complainant failed to produce any warranty card or Guaranty card in support in his contention.
He frankly submits that no such card was issued in his favour.
We find from the petition of compliant that till first 10 months complainant finds no complaint of the aforesaid product.
In absence of any warranty card or Guaranty card such type of allegation cannot be entertained.
In view of the aforesaid discussion we are of the firm view that complainant fail to establish prima facie case against the OP no. 1 to 3 relating to deficiency of service.
Accordingly, the case is not admitted.
Hence,
It is ordered,
That the present case vide no. CC/99/2022 be and the same is dismissed as not admitted.
