Final Order / Judgement

Vinay Vs. ICICI Lombard Insurance

Present:       Sh. Deepak Ahlawat, Advocate for the complainant.

                                Sh. Gulshan Chawla, Advocate for the opposite party.

                   Sh. Amit Chaudhary in person.

                   File taken up today on an application moved by the learned counsel for the complainant.

                   Sh. Amit Chaudhary came present today and got recorded his statement that in present case he had made claim in the company and at that time Vinay Rana was the registered owner of the vehicle. So he has no objection in giving the claim amount to Vinay Rana nor he will make any claim in insurance company in this regard in future also.

                    Learned counsel for the opposite party made a statement that matter has been settled with the complainant for full and final amount of Rs.5,62,000/- (Rupees Five lacs sixty two thousand only) and the opposite party will pay the alleged amount to the complainant within 60 days from the date of order, failing which opposite party will be liable to make a settled amount alongwith interest @9% p.a from the date of order.

                   Learned counsel for the complainant made a statement that he has heard the above statement and has no grievances against respondent and the  matter be decided in the light of statement made by counsel for the opposite party.

                   In view of the statements made by both the parties, the present complaint is hereby disposed off being settled, with direction to the opposite party to pay the alleged amount of Rs.5,62,000/- (Rupees Five lacs sixty two thousand only) to the complainant within 60 days, failing which the opposite party shall be liable to pay interest @9% p.a. on the alleged amount from the date of decision till its realization to the complainant. Parties shall be bound by their respective statements.

                   Copy of this order shall be supplied to the parties free of cost. File be consigned to record room after due compliance.
