         Ms. S.S. Choudhury, learned counsel, appearing for the proforma respondent No.2 is present. None appeared for the appellant. On 23-8-2016, 24-10-2016, 22-12-2016, 14-3-2017, 16-5-2017, 27-7-2017, 24-10-2017, 29-1-2018 and 18-6-2018 there was no representation on behalf of the appelalnt.

         This appeal is pending since 2010.

          In view of the same, the appeal is dismissed for non-prosecution.

         Statutory amount deposited by the appellant shall be returned to the appellant or their authorised agent.
