Today is fixed for admission hearing.

The complainant is absent on repeated calls. None for the complainant is present and no steps is taken.

On scrutiny of the record it appears that the complainant has filed the instant case on 27.09.2024 against the OPs alleging deficiency in service against the OPs with the prayer for a direction to the OPs to pay an interest @ 18% p.a. on the purchased price of Rs.89,000/- from the date of payment till realization along with other prayer. It also appears from the complaint petition that the complainant resides at 1203, 12th floor, Tower-D1, 2, Jessore Road, Kolkata- 700028 under Nager Bazar P.S. against three OPs of which OP-3 carries their business within the jurisdiction of this Commission and the other Two OPs carry their business beyond the jurisdiction of this Commission. 

A petition U/S 34(2) of the CP Act, 2019 was also filed by the complainant at the time of institution of the Consumer Complaint and the same was registered as MA/442/2024. On perusal in reveals that the said petition is defective to some extent and as such the same is rejected. Besides that the documents as annexed with the complaint petition are illegible even no original document has been furnished for the complainant at the time of admission hearing to tally the same.

In view of the above, we are not inclined to entertain the Consumer Complaint for further proceedings and as such the same is not admitted.

However, the complainant is at liberty to file afresh on the same cause of action in appropriate forum or court of law, if so advised, and if not, otherwise barred by law.

MA/442/2024 is thus disposed of.
