SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This complaint filed by the complainant against the opposite parties alleging deficiency in service in respect of Medi Claim Policy issued by the 1st opposite party to the complainant. The 1st opposite party entered appearance and filed written version denying the allegation raised by the complainant against the 1st opposite party. The 2nd opposite party was called absent and set ex parte on 09/01/2020. Since 22/10/2019 onwards this case was adjourned for the purpose of taking steps against the 3rd opposite party by the complainant. Though the complainant was represented through counsel on all posting dates, no steps were seen taken by the complainant and finally when the case came up for consideration today, the counsel appearing for the complainant filed a memo reporting no instructions from the complainant. Hence we are of the opinion that the complainant is not interested to proceed with this complaint. In the above circumstances, we find that this is a fit case to be dismissed for default
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
