FINAL ORDER
An application has been filed by the complainant under section 35 of the C.P. Act, 2019 alleging deficiency in service against the OPs.
Ld. Advocate files one petition stating inter-alia that some mistakes or errors have taken place which cannot be cured by making amendment therefore he sought for withdrawal of the case with a permission to file the case afresh.
The order is written is separate sheet, being order No. 2 dtd 22.01.2021 which do form the part of this order.
Accordingly, the instant Consumer Complaint, being No. CC/11/2021 is dismissed as withdrawn.
Liberty is given to complainant to file the case afresh, if not otherwise barred.
Today the instant case is fixed for admission hearing.

Ld. Advocate for the complainant files a petition today praying for withdrawal of the case as per grounds stated therein and also sought for permission to file the case afresh.
Ld. Advocate for complainant submitted that during drafting of the consumer complaint some mistakes or errors have taken place which cannot be cured by amendments.
He further submits that permission should be given to the complainant to withdrawn the instant case and liberty should be given to the complainant to file the case afresh.

Prayer of the complainant is allowed and permission is given the complainant to withdraw the instant case and liberty is also given to the complainant to file afresh if not otherwise barred.
