Heard the argument advanced by the learned advocate for the complainant on admission of the case.

      Perused the complaint and records. On going through the facts of the complaint, the consideration/ loan amount in question is Rs. 98,00,000/- for which this commission is not having jurisdiction to try the case, though the complainant received Rs. 10,00,000/- in advance out of Rs. 98,00,000/- for implementation of the project, the amount of Rs. 10,00,000/- is not the consideration amount as per the say of complainant, but the sanctioned loan amount of Rs. 98,00,000/- is to be considered as consideration for the purpose of jurisdiction. Hence all documents are hereby directed to returned to the complainant to present it before Hon’ble KSCDRC for filing complaint and hence this case is closed.
