Final Order / Judgement

                         One of the registered Volunteer Organization named Gopabandhu Consumer Organization along with the Complainant No.2 and 3 have filed this case alleging deficiency-in-service by the O.Ps, where O.P No.1 is the Chief Executive Officer, NESCO, Januganj Golai, Balasore and O.P No.2 is the Sub-Divisional Officer, NESCO, Markona, Simulia, Balasore.

                    1. Succinctly put, the brief facts which are material to the case are  that the Complainants No.2 and 3 are the Consumers under the O.Ps and paying their electric bills regularly, but the O.Ps without any pre-notice/ intimation has disconnected the electricity from the transformer on 15.01.2015 at about 2.30 P.M. Thus, the Complainants No.2 and 3 enquired with O.P No.2 to know the cause of disconnection to the premises of them. Thereafter, the Complainants No.2 and 3 had taken shelter before the Complainant No.1 and intimated to the O.Ps time to time, but the O.Ps due to their highhandedness caused the sufferings to the Complainants No.2 and 3. This fact was brought to the knowledge of O.P No.2 over Telephone on 29.01.2015 at 2.15 P.M. And also no Law has allowed the O.Ps to disconnect the electricity to the premises of the Complainants No.2 and 3, which may be considered as deficiency-in-service. Prayer for restoration of electricity to the premises of the Complainants No.2 and 3 along with compensation and litigation cost to the Complainants No.2 and 3.

                    2. Though sufficient opportunities were given to the O.Ps, but they neither appeared in the case nor filed their written version, hence the O.Ps are set ex- parte.

                    3. On perusal of the case record, it came to our notice that this case was instituted on 02.02.2015 and on the same date it was admitted. Then the case was posted on 16.02.2015 for appearance of the O.Ps. On that day, a petition supported by an affidavit has been filed by the son of Sri Nilamani Padhi (Complainant No.2) disclosing that on 05.02.2015 at 5.00 P.M, the electricity connection was given to the premises of the Consumers. Similarly on 27.06.2017, another affidavit has been filed by the Complainant No.1 disclosing about the same fact of reconnection of electricity to the premises of the Consumers.

                    4. Basing on these materials, this case needs no consideration at this stage and the case is to be disposed of accordingly. Hence, Ordered:- 

                                                     O R D E R

                         The Consumer case is disposed of accordingly as prayer of the Complainants has been duly complied by the O.Ps. No Cost.

                         Pronounced in the open Forum on this day i.e. the 10th day of July, 2017 given under my Signature & Seal of the Forum.
