The Complainant files hazira through advocate.

No step is taken by the O.P.

Statutory period for filing written version has already expired. So the case is taken up for disposal.

The Complainant’s case is that he being a small and marginal farmer took a loan of Rs.2,81,250/- from O.P.1 against deposit of security under Gramin Yojona Bhandar Prakalpa for construction of godown for storage of vegetable produce. The Complainant went on depositing the EMI for the said loan from time to time but all on a sudden he received a Demand notice of Rs.3,96,388/- dated:16/03/2018 from O.P.1. The Complainant has approached this Commission for appropriate relief challenging the said Demand notice.

Both the O.P.s made their appearance but they did not prefer to contest the case by filing any written version.

-: Decision with reasons: -

Admittedly the instant dispute arises between the O.P. / Co-operative Society and the Complainant / Borrower with regard to the loan amount sanctioned by the O.P.2 Authority and in view of Section 102 (1)(d) of West Bengal Co-operative Societies Act, 2006 the Commission has no jurisdiction to entertain such dispute for adjudication. Section 145 (2) of the said Act also ousts expressly the jurisdiction of this Commission in regard to anything done or any action taken or any order passed under this Act. The competent Authority for adjudication / settlement of all such dispute is the concerned Registrar appointed under the said Act. The Complainant is given liberty to move before the appropriate authority for redressal of his grievance and obtaining proper relief.

Hence it is ordered……..

That the instant case is dismissed on maintainability point as above.

Both parties be supplied copy of this Judgement free of cost.
