Final Order Order No. 02 The case record is put up before me on the prayer of the Ld. Advocate for the complainant. One Shri Arvind Kumar Mahato has appeared before this Commission today to identify by his conducting advocate as the S/o the complainant Shri Mahesh Mahato. Ld. Advcoate Shri Bratin Kumar Dey and Shri Arun Goswami had submitted that this Arvind Kumar Mahato being the S/o the complainant Shri Mahesh Mahato used to look after this case on the strength of a power of attorney executed in his favour by the complainant Shri Mahesh Mahato. Shri Arvind Kumar Mahato is present before this Commission and categorically stated that Mahesh Mahato is not willing to proceed with the case further more and he is praying for dismissal of the case for non-prosecution. NO- 241/2021 Considering the facts and circumstances and the statement of Shri Arvind Kumar Mahato being the S/o the complainant Shri Mahesh Mahato, the content of the power of attorney executed by Shri Mahesh Mahato and the submission of the Ld. Advocate for the complainant this Commission is in view that when the complainant is not willing to proceed with the case furthermore then there is no predicament to allow him to withdraw the case. Hence, Ordered:- That the petition filed by complainant Shri Arvind Kumar Mahato on behalf of the complainant Shri Mahesh Mahato for withdrawal of the case is hereby considered and allowed.
