This is a complaint filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

        1.This complaint is filed by the complainant alleging that the complainant was not paid with gratuity on the enhanced ceiling of the gratuity. Opposite party entered appearance through counsel. Complainant was continuously absent.  Opposite party submits that they have disbursed the amount to the complainant and as such there is no grievance to be reimbursed. A memo to that effect was also field by the opposite party.

          2.It is seen that the complainant is continuously not appearing before this Commission. It seems that the complainant is not willing to further proceed with this complaint. In view of the continuous absence of the complainant and on the basis of the statement made by the opposite party we find that this is a fit case to be dismissed for default.

          In the result, the complaint is dismissed. There will be no order as to costs.

      A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
