The complainant here, is an investor who invested Rs. 43,000/- into the fixed deposit scheme of five years of the O.P vide certificate 071012273874 on 27.07.2012. The Complt. was assured a maturity amount of Rs. 1,00,000/-, upon the completion of the term on 27.07.2018 (photocopy of the certificate marked as P1). However, even after several months of completion of the term of maturity, the O.P. did not bother to credit the amount to the Complt. Thus, aggrieved and harassed, the Complt  has prayed to this Commission for:

1. An order directing the O.P. to pay the Complt. Rs. 1,00,000/-, for maturity amount + 15% interest till realization of the full amount
2. Direction to the O.P. to pay Rs. 50,000/- to the Complt. for causing physical and mental harassment
3. Litigation cost of Rs. 10,000/-

                To prove his case Complt. has tendered her written examination-in-chief supported by evidence on affidavit and she has also filed photocopies of all relevant documents in support of her case.

                 We have gone through the said evidence of the Complt. and the documents filed by her.

                It appears that in his evidence the Complt. has fully corroborated her case of the petition of the complaint and the documents filed by her also lend support to the case of the Complt. So, in view of the said evidence of the Complt. and the documents filed by her, remaining un-challenged, it is held that the Complt.’s case is proved and she is entitled to get the reliefs as sought for.

             Hence,

                            It is,

                                          ORDERED

That the instant case no. 68/2019 is allowed ex-parte with cost against the O.P.

        O.P. is directed to pay maturity amount of Rs. 1,00,000/- to the Complt. as per terms and conditions mentioned in the scheme, along with interest @ 6% p.a. from the date of maturity till realization of the full amount.

        O.P. is categorically directed to pay compensation of Rs. 20,000/- to the Complt. for mental harassment and financial negligence.

         O.P. is also directed to pay Rs. 5,000/- as litigation cost to the Complt.

         All such payments shall be made within 45 days from the date of this order.

        Let a free copy of this order be given to the Complt. free of cost.
