Hazira is filed on behalf of the complainant through advocate.
No step is taken on behalf of the O.P. nor any W.V. filed.
The O.P. has got several opportunity to file W.V. to contest the case but no W.V. has been filed even long after the expiry of the statutory period for filing W.V. The Commission therefore decides to proceed Ex-parte against the O.P..
The complainant case is that he made an application for availing loan under SVSKP Schene formulated by the Govt. of India and Reserve Bank of India and in due consideration the proposal for loan was sanctioned by the PIC, Chhatna and the sanctioned loan was duly communicated by the O.P. to the complainant by a letter dated: 13-02-2018 No. being JHRE/ADV/133/2017-2018 containing the terms and conditions of the loan. Thereafter the complainant in due course of time went to the O.P. Bank to deposit the margin money of Rs.33,000/- as one of the terms and conditions of the loan but the O.P. Bank refused to accept the same. The complainant has therefore approached this Commission for sanction of the proposed loan by accepting deposit of margin money of Rs.33,000/- praying for compensation of Rs.50,000/-

In support of the complaint case the complainant has produced the proposed loan sanction order along with relevant documents. On perusal of all the documents the Commission finds that the proposed loan under SVSKP Scheme has been sanctioned in the Year 2018 with margin money of Rs.33,000/- to be deposited by the loanee and the loan is to be sanctioned subject to observance of other formalities as contained in the terms and conditions of the loan.
It is not clear from the record whether the complainant is in a position to comply with all the terms and conditions of the loan and whether the Sanctioning Authority is still in a position to favour the complainant with the sanction of the proposed loan after lapse of about 4-5 years.
It is true that when loan has been sanctioned it is the duty of the concerned authority to disburse the loan after observing all legal formalities and compliance of the terms and conditions of the loan. Apart from depositing of margin money the complainant has to go a long a way to get the loan disbursed in his favour and without the assistance and favour of the O.P. it is difficult for the complainant to get the loan amount in due process of law.
Accordingly the case is disposed of with the direction upon the O.P. to extend all co-operations to the complainant in getting the sanctioned loan disbursed in his favour subject to terms and conditions and other legal formalities of the loan.
Both parties be supplied copy of this judgement free of cost.
