Today is fixed for evidence by the complainant as last chance i.d necessary order.

Ld. Adv. for the OP no 1-3  is present. complainant is absent without any steps.

  His Ld. Adv. surrenders the V’nama.

 Hd. both sides.

 Ld. Adv. Mr. Romeet Sil is released from this case.

 Perused record.

 We find that complainant took several adjournment  for filing evidence  and some times he also made him absent on the date of hearing.

 On 15.09.2022 adjournment        was given to him and 22.11.2022 was  fixed for evidence as last chance but he was not ready on 22.11.2022 and again prays for adjournment  .

 However, that was also allowed and today i.e 05.01.2023 as evidence as last chance.

 Today complainant  is absent without any steps.

Conduct of the complainant   indicates that he is trying to delay  the case.

 Considering the entire matter we are not inclined to  adjourned the case.

 Hence

 that the  present case vide no. CC/255/2019 is dismissed for default but without any order as to cost.
