Both parties are absent without step. Perused the case record. We find that there is no copy of stay passed by the Hon’ble State Commission in this case.There is no paper or copy of order in the record wherefrom one can say that the Jdr. ever preferred appeal before the Hon’ble State Commission against the order/judgment passed by this Forum against which this execution case has been arisen. Ld. Lawyer for the Dhr. orally submitted on 08/04/2014 that the Jdr. preferred appeal . Since then neither the Jdr nor the Dhr. filed any papers or copy of order of the Hon’ble State Commission to show that the Jdr. preferred appeal before the Hon’ble State Commission against the judgment/order passed by this Forum in original CC 52/2013. The Dhr. was absent on the previous date without step. Today Dhr. is absent without step. He is also found absent on calls. In the circumstances the execution case deserves dismissal. Hence it is 

ORDERED

that the execution case stands dismissed for default without cost.
