          This is a complaint filed u/s 12  of Consumer Protection Act, 1986 for directing the Opposite Parties  to deliver the new and updated version of the mobile of the "Z" series immediately or in the alternative to refund the mobile amount of Rs.35,300/-;  to direct the opposite parties to come forward to pay damages suffered and pay compensation of Rs.50,000/- for the physical and mental suffering underwent and Rs.10,000/- for legal expenses and to pay cost of this proceedings.      

          2. Notice to the opposite parties were duly served.   The Opposite Party Nos. 1 and 3 remained absent and set ex parte.  The Opposite Party No.2 was initially absent and set ex parte and then filed petition in M.P. 95/2016 for setting aside the ex parte through Counsel and the same was allowed. 

          3. Today this complaint was called.  Complainant present, Counsel absent, second opposite party absent, but Counsel represented.  Complainant and second Opposite Party filed compromise memo.  In view of the compromise memo, this complaint is hereby dismissed as withdrawn.  The compromise memo shall form part and parcel of the order.  No costs.

EXTRACT OF MEMO FILED BY THE PARTIES

 

          Both the complainant and the second opposite party had jointly arrived to the compromise on the following terms:

 

  1. That the Opposite Party No.3 has paid the mobile price of Rs.35,300/- to the complainant.
  2. That the Opposite Party No.3 has paid an amount of Rs.3,000/- to the complainant towards litigation expenses incurred vide cheque No. 801890 dated 07.11.2016 a sum of Rs.38,300/- towards full and final settlement with full satisfaction.
  3. The complainant withdraws the allegations made against the opposite parties.
  4. The complainant and respondent herein has agreed not to claim any right over among them in future.
  5. The opposite party No.2 is permitted to take back the mobile phone from the Consumer Forum.
