Heard the arguments of complainant on admission of the complaint.

     This complaint filed by Mr.C.G. Poovaiah s/o. C.D. Ganapathy resident of Subramanya Nagar, Madikeri against the opponents Chamundeshwari Electric Supply Company and Vigilance Squad, Madikeri with a prayer to direct the opponents to waive the penalty and also award Rs.25,000/- as compensation for mental agony, monitory loss etc.  On perusal of the complaint, copy of notice and bill issued by the opponent in respect of RR No.MA 1270 and AEH 1556 indicate that the complainant is in arrears of Rs.11,018/- and Rs.1,241/- respectively. The bill was issued on 14/09/2018 by fixing the last date of payment as 28/09/2018.

     The opponents have not levied penalty on the complainant as alleged by him and on the contrary the bill indicates that the complainant is in arrears of electricity charges.  This Forum is not having power or jurisdiction to decide whether the complainant is in arrears of electricity charges.  On the contrary, the complainant prays to waive the penalty imposed by the

opponents.  The opponents have not levied penalty on the complainant in the bill dated 14/09/2018.  Therefore, the complaint filed by the complainant is misconceived hence, it deserves to be dismissed.  Accordingly, we proceed to pass the following;

O R D E R

    The complaint filed by the complainant is misconceived hence, it is dismissed without cost.
