Complainant’s daughter who is residing at abroad is the owner of the house and opposite party issued water bill in the name of the complainant.  On 4/6/16 a bill was received from the opposite party wherein she was asked to install the new meter. Accordingly on 7/10/2016  she remitted the due amount of Rs. 135 and testing charge of Rs. 10 and the new meter worth Rs. 900/- was fitted.  Thereafter on 5/4/2017 he received another notice from the opposite party demanding her to remove the meter that he fitted.  The act of the opposite party caused much financial loss and alleging deficiency in service the complaint is filed.
2.Version of the opposite parties as follows:-
The complainant remitted water bill upto 2012 December. Opposite party required test in the name of the consumer named Nazeema whose Consumer number is AWS-8980-D.  The Consumer Number of the complainant is AWN-11624-D.  Since the complainant herself committed default the opposite party is not liable to compensate the complainant.
3. The power of attorney holder was examined as PW1, documents produced were marked as Ext.A1 to A2 series.  No oral or documentary evidence adduced on the part of the opposite party.
4. Points for Consideration are:-
1)Whether there is any deficiency in service on the part of the opposite parties?
2)  If so the reliefs and costs? 
5.  It is an admitted fact that the complainant is availing a water connection in consumer No. AWN-11624-D.  According to the complainant on 4/6/2016 she got a bill wherein she was asked to install a new water meter.  The said demand notice dated 4/6/2016 produced and marked as Ext.A1.  On getting the said notice complainant remitted Rs. 135 towards arrears and fitting charges of Rs. 10 with the opposite party Ext.A2 series evidenced  the same.  There after opposite party came to see that the meter test is to be conducted in Consumer No. AWS-8980-D.  According to the complainant she was asked to test the meter by mistake by the opposite party and that caused much financial loss to the complainant.  But at the same time it is seen that he has not removed the meter from his connection and now the opposite party is testing the water consumed as per the meter reading of the new meter.  Opposite party has charged Rs.135 from complainant by mistake and they are liable to refund it.  Since the complainant is using the same meter in consumer No. AWN 11624-D she cannot claim any amount towards compensation.
In the result complaint party allowed.   The opposite party  is directed to refund Rs. 135 only  to the complainant.
