The instant case for execution of the order passed on 27/02/2017 by this Forum in CC No. 28/2016 has been raised by the D.Hr. Sri Biswajit Roy Choudhury, here in the complainant against the J.Dr. i.e. A.E. & Station Manager, Gamgarampur, C.C.C., W.B.S.E.D.Co. Ltd. and the D.E. & Divisional Manager Dakshin Dinajpur (D) Division, W.B.S.E.D.Co. Ltd. here in the OPs.

The fact of the case goes that the J.Dr. i.e. the OPs in the instant case have not complied with the order passed on 27/02/2017 by this Forum in CC No. 28/16 till 22/05/2017. The complainant finding no other way has come to this Forum praying for enforcement of the said order. In the mean time, the Ld. Advocate of the OPs in its written statement confirmed that the OPs have filed an appeal to the State Consumer Disputes Redressal Commission, West Bengal against the said order vide Appeal Case No. A/421/2017, though on different dates of hearing at this Forum the Ld. Lawyer of the OPs has produced the letter of intimation and proceedings in the appeal case at the State Commission but no stay order could be produced and filed, but there was enough cause of believing that the case is pending with the S.C.D.R.C., so the verdict of the Hon’ble S.C.D.R.C., West Bengal was awaited.

Now, the judgment order dt. 15/01/2018 by Hon’ble S.C.D.R.C. in Appeal Case no. A/421/2017 has come to our hand. All concerned are bound by the verdict of the S.C.D.R.C., West Bengal in the instant case.

It is directed to both the parties to observe strictly the observation of the said higher judiciary.

The instant case stands disposed off bearing no litigation cost.
